SMEs should claim interests or recovery costs to those clients that are not paying on time.
The regulation of the Union European establishes that enterprises are entitled to claim default interest to the clients who are not paying on time their invoices. In addition, the creditor can request the automatic payment of a flat rate amount, as a compensation for the recovery costs. Considering a minimum amount of 40 euros. The regulation is applicable to all the business operations between other enterprises, freelancers or the public administration.

An unpaid bill is one of the most serious problems that an employer has to face on, in our country this situation happens very often. It does not only does affect to the claimant, but also to the country economy. According with the study “Informe de Pagos por Sectores 2016”, non-payments affects in different way depending on the economic sector, however sectors such as mining, financial service or transport and storing suffer the most serious consequences.

Nine out of ten enterprises do not claim default interests
There are concerns among Spanish enterprises to claim their rights in case of late payment. This behaviour is contrary to what is established by the law 3/2004, which points out that it must be applied an interest of 8 percentage points above the cost of money, the payment is set at sixty days following the date of receipt of the invoice. The 96% of the enterprise never ask for the payment of compensation for the recovery costs or non-payments.
